Omo-Agege seeking to govern through 'backdoor' - Izeze ~ Truth Reporters








Delta State Commissioner for Works (Highways and Urban Roads) Comrade Reuben Izeze has slammed the All Progressives Congress (APC) Governorship candidate, Senator Ovie Omo-Agege for seeking to govern the state through the backdoor.

Izeze in a statement on his Facebook page on Saturday morning, congratulated Governor Sheriff Oborevwori, the Peoples Democratic Party (PDP) and Deltans on the confirmation of Oborevwori's election by the Governorship Election Petitions Tribunal sitting in Asaba.

The Tribunal had dismissed the petitions of the APC, SDP and Labour Party candidates for failing to prove their allegations of corrupt practices and non-compliance to the Electoral Act 2022 as amended.

Omo-Agege has since notified that he was heading to the Appeal court for further litigation on the matter.

In his Facebook post titled "And so it came to BE!!!", Izeze appealed to the litigants to join hands with Governor Oborevwori to develop Delta State.

According to the statement, "While I do NOT intend to gloat over the overwhelming loss of the petitioners in yesterday's Governorship election petitions tribunal verdicts, I would like to remind my pals here of one of my previous post in which I made allusions as to "there being a town/village after ones own no matter how far one might claim ones town/village is".

"The fundamentals of the judgment in the case of the APC and the response of the petitioner in that case makes one to wonder what kind of politics would make people to seek to Govern our people through the backdoor!!!

The essentials of the verdict by the Panel include but not limited to the following;
-The backroom server is unknown to the Electoral Act.
-The only means through which a petitioner can prove overvoting(or under voting as the case may be) is through the IREV(properly pleaded and tendered).
-Hearsay evidence remains inadmissible in Law.
-Issues bordering on criminality must be proven beyond reasonable doubt.

He said a petitioner can NOT depend on the panel of ĵudges to descend into the arena and litigate on his behalf. He who alleges must as a matter of law and fact, prove his case.

This was a unanimous judgment of the three learned judges on the Panel. And yet someone says the judges did not "aver their minds to the intendment of the Legislature" in arriving at this very obvious and sound judgment.

Suddenly the "intendment of parliament/the Legislature" is now the exclusive preserve of one individual(little wonder the;"na me write am" narrative was sold back then until it boomeranged and they quickly beat a retreat)!!!

The Works Commissioner further averred that "It is elementary Law that where the wordings of an Act or Statute are clear and unambiguous,the judge is required to simply give those words their ordinary(LITERAL) meaning without importing any other meaning to it.This LITERAL CANON OF INTERPRETATION cannot be wished away by any judge worth their onions in a bid to satisfy the whims and caprices of any litigant.

"For me and the truly honest Deltans who are non-partisan, we know that Rt.Hon.Elder Sheriff Francis Orowhoedor OBOREVWORI won the GUBERNATORIAL ELECTIONS OF THE 18TH OF MARCH 2023 OVERWHELMINGLY.

"His mandate was DIVINELY ORDAINED and PHYSICALLY VALIDATED by the VAST MAJORITY OF DELTANS IN 21 of our 25 Local Government Areas.

"I therefore appeal to our litigating brothers to sheath their swords and join hands with our Governor in building a MORE ADVANCED DELTA STATE!!!

"As usual,there are no winners and no losers here. It is CONGRATULATIONS TO ALL DELTANS!!!," he stated.
